4. Who we share your data with

We share personal data only as needed, with:

  • E-commerce and hosting providers (for example Shopify) that run the Site and store order data.
  • Payment providers (for example Shopify Payments, PayPal and the other methods offered at checkout).
  • Fulfilment partners, suppliers and shipping carriers that prepare and deliver your order and need your name, address, phone number and email for delivery and customs.
  • Email, customer-support and marketing tools that send our messages and manage requests.
  • Analytics and advertising partners (for example Google, Meta, TikTok), through cookies and pixels, where you have consented or where the law allows.
  • Professional advisers, authorities and courts, where we must by law or to protect our legal rights.
  • A buyer or successor, if our business is sold or reorganised, under the same protections.

These providers act as our processors or as independent controllers, depending on the service. We do not sell your personal data for money.

5. International transfers

Some of our providers are located outside the European Economic Area or the United Kingdom, including in the United States. When we transfer personal data internationally, we use safeguards recognised by law, such as the European Commission's Standard Contractual Clauses, the UK International Data Transfer Addendum, or an adequacy decision such as the EU-U.S. Data Privacy Framework where the recipient is certified.

6. How long we keep your data

  • Order and invoice data: for as long as the law requires for tax and accounting purposes (in Spain, generally up to six years or more where legally required).
  • Customer-support messages: up to three years after our last contact.
  • Marketing data: until you unsubscribe or withdraw consent, and then only the minimum needed to respect your opt-out.
  • Cookie and analytics data: according to the retention periods in our cookie settings, usually up to 24 months.
  • Data needed for legal claims: for the limitation period of potential claims.

When data is no longer needed, we delete or anonymise it.

7. Your rights

If you are in the EU or UK you have the right to: access your data; correct inaccurate data; delete your data ("right to be forgotten") where applicable; restrict processing; object to processing based on legitimate interests or to direct marketing; data portability; withdraw consent at any time; and not be subject to decisions based solely on automated processing that significantly affect you (we do not make such decisions).

To exercise a right, email NiteGuard@outlook.com. We may need to verify your identity, and we will reply within one month (this period can be extended by law in complex cases). You also have the right to complain to a supervisory authority: in Spain, the Spanish Data Protection Agency (Agencia Española de Protección de Datos, www.aepd.es); in the UK, the Information Commissioner's Office (ico.org.uk); or the authority in your country of residence.

8. Cookies and similar technologies

We use cookies, pixels and similar technologies for: (a) essential purposes, such as keeping your cart, remembering your session and securing checkout; (b) analytics, to understand how the Site is used; and (c) marketing, to measure our advertising and show our ads on other platforms. Non-essential cookies are used only with your consent where the law requires it. You can accept, reject or change your choices through the cookie banner on the Site and through your browser settings. Blocking some cookies may affect how the Site works.

9. Marketing communications

You can unsubscribe from marketing emails at any time using the link in each email or by writing to NiteGuard@outlook.com. We will still send you service messages about your orders. We send text messages only if you have given express consent.

10. Additional information for California and other US residents

If you live in California or another US state with a consumer privacy law, you may have the right to: know what personal information we collect, use, disclose or share; request a copy; request correction or deletion; opt out of the "sale" or "sharing" of personal information for cross-context behavioural advertising; and not be discriminated against for exercising your rights.

  • Categories collected in the last 12 months: identifiers (name, email, address, IP address); commercial information (orders); internet activity (browsing data); geolocation (approximate); and customer-service communications.
  • Sale or sharing: we do not sell personal information for money. The use of advertising cookies and pixels may count as "sharing" or "sale" under some state laws. You can opt out through our cookie settings, by enabling a browser opt-out signal such as Global Privacy Control, which we honour where required, or by emailing NiteGuard@outlook.com with the subject "Do Not Sell or Share".
  • Sensitive personal information: we do not intentionally collect it, other than payment details processed by our payment providers.
  • Authorised agents: you may use an authorised agent to submit a request; we may ask for proof of authority and verification of your identity.

11. Children

The Site and the Products are intended for adults aged 18 and over. We do not knowingly collect personal data from anyone under 18. If you believe a minor has given us personal data, contact us and we will delete it.

12. Security

We use appropriate technical and organisational measures to protect your data, including encrypted connections (HTTPS) and access controls, and we rely on payment providers that follow industry security standards. No online system is completely secure, and we cannot guarantee absolute security. If a data breach affects your rights, we will notify you and the authorities as required by law.

13. Discretion

We understand that some customers value discretion. We use only the information needed to process and deliver your order, we ship in plain packaging that does not describe the contents, and we do not use the product you bought to infer sensitive information about you. We cannot control how your bank displays a transaction on your statement.

The Site may contain links to third-party websites. We are not responsible for their privacy practices. Please read their policies before giving them your data.

15. Changes to this policy

We may update this Privacy Policy from time to time. The latest version is always on the Site with the date of the last update at the top. If we make material changes, we will take reasonable steps to let you know.
