Terms and Conditions

Last updated: October 15, 2026

These Terms and Conditions (the "Terms") govern your access to and use of GetNiteGuard.store (the "Site") and every purchase of NiteGuard products (the "Products") made through it. By browsing the Site or placing an order, you confirm that you have read, understood and accepted these Terms, together with our Privacy Policy and our Shipping and Returns Policy, which form part of them. If you do not agree, please do not use the Site or place an order.

1. Who we are

The Site is operated by [LEGAL NAME / BUSINESS NAME] ("NiteGuard", "we", "us" or "our"), with registered address at [STREET AND NUMBER], Retiro, 28007 Madrid, Spain. Tax ID (NIF/CIF/VAT): [TAX ID NUMBER]. Email: NiteGuard@outlook.com. Website: GetNiteGuard.store.

2. Eligibility

The Site and the Products are intended for adults. By placing an order you confirm that you are at least 18 years old, that you have the legal capacity to enter into a binding contract, and that you are buying for your own personal use. We may limit the quantity of Products per order or per customer, and we may refuse orders that appear to be placed for resale without our written consent.

3. Important safety information about the Products (please read carefully)

3.1 What the Products are. NiteGuard Products are single-use, discreet nail stickers with test pads. They are designed to give a quick, consumer-level indication (a "screening") of the presence of certain substances in a small drop of a drink.

3.2 Limited detection. The Products react only to a limited number of specific substances, as described on the product page and on the packaging [CONFIRM EXACT LIST WITH SUPPLIER, e.g. GHB, ketamine and certain related compounds]. They do not detect added alcohol, which is the most common way drinks are spiked, and they do not detect most other drugs, medications or contaminants. They may not detect every form, dose or concentration of the substances they are designed to screen for.

3.3 A negative result is not a guarantee of safety. A negative result only means that the specific substances the Product screens for were not detected in the drop tested, at the sensitivity of the test. It does not mean that a drink is safe to consume.

3.4 False positives, false negatives and interfering drinks. Results can be affected by the type of drink (for example milk-based or cream-based drinks, very acidic drinks, and dark red wine or dark berry drinks), by the way the Product is used, by lighting conditions, by individual colour perception, and by the age and storage conditions of the Product. A Product may show a positive result when no relevant substance is present (false positive) or fail to show a positive result when a relevant substance is present (false negative).

3.5 Not a medical, diagnostic or forensic product. The Products are consumer screening indicators. They are not medical devices, diagnostic tests or forensic tests. A result from a Product cannot prove that a drink was or was not spiked and must not be used as evidence, or as the sole basis for accusing any person.

3.6 If you think you have been spiked. Stop drinking immediately, do not leave the drink or the venue alone, tell a trusted person and the venue staff, keep the glass if you can, and seek medical help straight away. In an emergency call your local emergency number (112 in the European Union, 911 in the United States and Canada, 999 in the United Kingdom). Report the incident to the police so that proper testing can be carried out.

3.7 Your personal safety remains your responsibility. Using a Product does not replace common-sense precautions: keep your drink with you, do not accept drinks from people you do not know or trust, do not leave a drink unattended, stay with people you trust, and trust your instincts if something feels wrong.

3.8 Correct and safe use. Follow the instructions on the packaging and on the Site. Each sticker is for single use only. Apply it to a clean, dry nail. Do not ingest the Product, keep it away from children and pets, and do not apply it to broken or irritated skin. Stop using the Product and seek advice if you experience any skin irritation or allergic reaction. Store the Products sealed, dry, and away from heat and direct sunlight, and do not use them after the expiry date shown on the packaging.

3.9 Descriptions, images and testimonials. Product descriptions, images and customer testimonials are for general information. Individual experiences and results may vary, and nothing on the Site is a promise that a Product will detect any particular substance in any particular situation.

4. Use of the Site

You agree to use the Site lawfully and in good faith. You must not: (a) provide false or misleading information; (b) use the Site or the Products to harass, harm, defame or falsely accuse any person; (c) attempt to gain unauthorised access to the Site, our systems or other users' data; (d) use bots, scrapers or similar tools without our written permission; (e) interfere with the security or normal operation of the Site; or (f) use the Site for any unlawful purpose.

5. Orders and formation of the contract

Product pages are an invitation to order. When you place an order you make an offer to buy. The automatic email we send after checkout confirms that we have received your order; it is not our acceptance. A binding contract is formed only when we dispatch your order and send you a shipping confirmation, or when we otherwise confirm acceptance in writing. We may decline or cancel an order, in whole or in part, for reasons including product unavailability, pricing or description errors, suspected fraud or abuse, payment problems, or because we cannot deliver to your address. If we cancel an order you have already paid for, we will refund the amount paid in full.

6. Prices, currency and taxes

Prices are shown in US dollars ($) unless the Site states otherwise. The total price, including any shipping charges and applicable taxes, is shown at checkout before you confirm payment. Where the law requires, prices for consumers in the European Union and the United Kingdom include VAT; sales tax for other destinations is calculated at checkout where applicable. Import duties, customs fees and local taxes charged by the destination country (where applicable) are described in our Shipping and Returns Policy. Your bank or card issuer may apply currency conversion or international transaction fees, which we do not control. We make reasonable efforts to display correct prices; if a price is clearly wrong, we may cancel the order and refund you in full, or offer you the chance to confirm the order at the correct price.

7. Payment

Payments are processed by third-party payment providers (such as Shopify Payments, PayPal and the other methods shown at checkout). We do not store your full card details. By placing an order you authorise the charge of the total amount shown. Orders may be subject to fraud-prevention and verification checks, which may delay or prevent processing. We aim for a neutral description of the charge on your statement, but we cannot control how your bank displays it. If you have a problem with a charge, please contact us first at NiteGuard@outlook.com so that we can resolve it quickly.

8. Bundles, discounts and promotions

Bundle prices (for example multi-pack options) and discount codes apply only as described at the time of the offer. Unless stated otherwise, discount codes cannot be combined, have no cash value, and may be withdrawn at any time for orders not yet placed. "Compare-at" or crossed-out prices are shown for reference only. We may cancel orders obtained through misuse of a promotion.

9. Shipping and delivery

Orders are processed and delivered as described in our Shipping and Returns Policy. Estimated delivery times are estimates, not guarantees. Risk of loss or damage to the Products passes to you when the Products are delivered to the address you gave us, and ownership passes to you when we have received full payment.

10. Returns, refunds and your right of withdrawal

Our Shipping and Returns Policy sets out how returns and refunds work. If you are a consumer in the European Union or the United Kingdom, you have a statutory right to withdraw from a distance contract within 14 days of receiving the goods without giving a reason. This right does not apply to sealed goods that are not suitable for return for health-protection or hygiene reasons if they have been unsealed after delivery. Our 30-day return window for unopened packs is offered in addition to, and does not reduce, your statutory rights.

We are responsible for delivering Products that conform to the contract. If you receive a Product that is defective, damaged or not as described, please contact us as soon as possible at NiteGuard@outlook.com with your order number and photos, and we will repair, replace or refund as required by law and by our policy. Consumers in Spain and the European Union benefit from the legal guarantee of conformity under applicable law (in Spain, three years for new goods), and consumers elsewhere keep the statutory rights granted by the law of their country. Nothing in these Terms limits those rights. Products have a limited shelf life, and the expiry date on the packaging applies.

12. Intellectual property

All content on the Site, including the NiteGuard name, logo, text, graphics, images, product designs, layout and code, is owned by or licensed to us and is protected by intellectual property laws. You may view and print pages for your personal, non-commercial use. You may not copy, reproduce, modify, distribute or exploit any content without our prior written consent.

13. Reviews and content you submit

If you submit a review, photo, message or other content, you confirm that it is truthful, that you own it or have the right to submit it, and that it does not infringe anyone's rights or break the law. You grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce and adapt that content on the Site and in our marketing, and we may remove it at any time. We do not endorse the opinions expressed in user content.

14. Disclaimer of warranties

To the fullest extent permitted by applicable law, and without affecting your statutory consumer rights, the Site is provided "as is" and "as available", and we do not warrant that the Site will be uninterrupted or error-free. Except as expressly stated in these Terms or required by law, we give no warranty that any Product will detect any particular substance, in any particular drink, or in any particular circumstances.

15. Limitation of liability

15.1 What is not limited. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under mandatory product-liability law, or for any liability that cannot be excluded or limited by law, and nothing affects your mandatory rights as a consumer.

15.2 What is limited. Subject to clause 15.1 and to the fullest extent permitted by law, we are not liable for: (a) any harm, loss or damage arising from your reliance on, or interpretation of, a test result, including a negative result, a false negative or a false positive; (b) any harm, loss or damage caused by the acts or omissions of third parties, including criminal acts; (c) any use of the Products that is contrary to the instructions or these Terms; (d) loss of profit, loss of business, or any indirect or consequential loss that was not reasonably foreseeable when the contract was made; or (e) delays or failures caused by events outside our reasonable control.

15.3 Cap. Subject to clause 15.1 and to the fullest extent permitted by law, our total liability to you arising out of or in connection with an order will not exceed the price you paid for the Product(s) concerned.

16. Your acknowledgement

By purchasing a Product you confirm that you have read section 3, that you understand the limits of the Products, that you will not rely on a Product as your only protection, and that you use the Products at your own risk and responsibility, without prejudice to your statutory rights.

17. Indemnity

To the extent permitted by law, if you are not a consumer, you agree to compensate us for losses, claims and costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Products. This clause does not apply to consumers.

18. Privacy and cookies

We process personal data as described in our Privacy Policy. By using the Site you acknowledge that policy.

19. Marketing communications

We send you transactional emails about your orders. We will send marketing emails or messages only where you have opted in or where the law otherwise allows, and you can unsubscribe at any time using the link in the message or by writing to NiteGuard@outlook.com.

The Site may link to third-party websites or use third-party services (such as payment and shipping providers). We do not control them and are not responsible for their content, policies or practices.

21. Events beyond our control

We are not responsible for any delay or failure to perform our obligations caused by events beyond our reasonable control, including natural events, strikes, carrier or customs delays, supplier disruption, war, epidemics, power or internet failures, or government action. We will inform you if such an event affects your order, and you may cancel for a refund if the delay is significant.

22. Changes to these Terms or to the Site

We may update these Terms from time to time. The version published on the Site when you place your order applies to that order. We may also change, suspend or discontinue parts of the Site or any Product at any time.

23. Suspension and termination

We may suspend or restrict your access to the Site if you seriously or repeatedly breach these Terms or if we suspect fraud or abuse.

24. General

If any part of these Terms is found invalid or unenforceable, the rest remains in force. A failure to enforce a right is not a waiver of it. These Terms, together with our Privacy Policy and Shipping and Returns Policy, are the entire agreement between you and us about your purchases. We may transfer our rights and obligations under these Terms to another company; you may not transfer yours without our written consent. The contract is concluded in English.

25. Governing law and disputes

These Terms and any contract between you and us are governed by Spanish law. If you are a business customer, the courts of Madrid (Spain) have exclusive jurisdiction. If you are a consumer, you also keep the mandatory consumer-protection rights of the country where you live, and you may bring a claim in the courts of your country of residence. We will always try to resolve complaints amicably first: please write to NiteGuard@outlook.com and we will reply as soon as we can. Consumers in the European Union may also be able to use out-of-court dispute-resolution bodies available in their country. Nothing in this clause limits any statutory right you have under the laws of your state or country.
